TERMS AND CONDITIONS OF USE

You must be at least 16 years old to use the Service. By using the Service, you declare that you meet this condition and that you have the legal capacity to enter into this agreement.

The Service provides artificial intelligence-based tools and related software services available on daddyfreud.com.

The Service includes artificial intelligence-based features (the "AI Features"). The following applies:

Processing by third parties. The AI Features are provided through Vercel AI Gateway, which routes your requests to the AI model provider OpenAI, L.L.C. Your input data ("prompts") and related data are transmitted to and processed by this provider. Details, including data retention practices, are set out in our Privacy Policy.

Not therapy or professional advice. The Service may address personal, emotional, or psychological topics. The Service does not constitute psychotherapy, psychological counseling, medical care, or specialist advice of any kind and does not replace consultation with a qualified professional. In a crisis, call 112 or your local emergency services.

Do not submit sensitive data. Do not transmit confidential, proprietary, or special-category personal data (e.g., health data) through the AI Features, unless you accept that such data is processed by us and our AI provider in accordance with the Privacy Policy.

Accuracy. AI-generated results may be inaccurate, incomplete, or out of date. You are solely responsible for verifying and evaluating results before relying on them.

Results. You may use the AI-generated results for lawful purposes. We do not warrant that the results are unique or free of third-party rights.

You must provide accurate, current, and complete information when registering and keep it up to date.

You are responsible for your login credentials and for all activity that takes place under your account.

Notify us immediately of any unauthorized use at hello@daddyfreud.com.

We may suspend or terminate accounts that violate these Terms.

Payments are processed by our payment provider, Stripe, Inc. We do not store full card numbers on our systems; card data is collected and processed directly by Stripe.

Prices and billing cycles are displayed at checkout. Subscriptions renew automatically until cancelled. You may cancel at any time from your account settings or by writing to hello@daddyfreud.com; cancellation takes effect at the end of the current billing period.

EU consumer right of withdrawal. If you are a consumer in the European Union, you have the right to withdraw from your purchase within 14 days, without giving a reason, by sending an unequivocal statement to hello@daddyfreud.com. We refund payments within 14 days of withdrawal. Exception: this right does not apply if you expressly requested that the digital service or content be supplied during the withdrawal period and acknowledged that you thereby lose the right once performance has been completed, in accordance with Romanian Government Emergency Ordinance no. 34/2014.

We may change prices with reasonable prior notice; changes apply to subsequent billing periods.

The Service relies on the following providers, whose terms and privacy policies apply to the processing of data by them:

When you connect a third-party account through an integration (e.g., via Composio), you authorize us and our providers to access and process data from that account solely to perform the requested actions. You may only connect accounts you are authorized to use. We are not responsible for the acts or omissions of third-party providers.

You agree not to:

• use the Service for unlawful, fraudulent, or harmful purposes
• infringe the intellectual property, privacy, or other rights of others
• upload malicious code, scrape data, reverse engineer, or overload the Service
• bypass usage limits, security measures, or Cloudflare protections
• use the AI Features to generate illegal, harassing, deceptive, or harmful content or content that violates our AI provider's usage policies
• use the Service to develop a competing product
• misrepresent your identity or affiliation

You retain ownership of the content you submit (the "User Content"), including prompts and files sent to the AI Features.

You grant Daddy Freud a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display User Content solely to the extent necessary to operate and provide the Service.

You represent that you own or have the necessary rights to the User Content.

We may remove User Content that violates these Terms.

The Service — including the software, design, texts, graphics, and trademarks — is the property of Daddy Freud S.R.L. or its licensors. No rights are granted except those expressly set out in these Terms.

Our Privacy Policy describes how we and our providers collect, use, and share your data, including cookies and AI-related processing.

We may modify, suspend, or discontinue any part of the Service at any time. To the extent possible, we will give advance notice of substantial changes.

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that AI results will be accurate or that the Service will be uninterrupted or error-free. This does not affect rights that cannot be excluded under mandatory law, including the statutory rights of consumers.

To the maximum extent permitted by law, Daddy Freud S.R.L. shall not be liable for indirect, incidental, special, consequential, or punitive damages, nor for loss of profits, data, or reputation, arising from the use of the Service. Our total cumulative liability shall not exceed the greater of: (a) the amounts paid by you in the 12 months preceding the claim, or (b) EUR 100.

Nothing in these Terms excludes or limits liability for intent or gross negligence, for death or bodily injury, or any liability that cannot be excluded under Article 1081 of the Romanian Civil Code or other mandatory rules.

You agree to indemnify Daddy Freud S.R.L. for claims, damages, liabilities, and expenses (including reasonable attorney fees) arising from your use of the Service in violation of these Terms, from User Content, or from violation of law. This section does not apply to consumers to the extent it would be inapplicable under mandatory law.

We may suspend or terminate your access, with or without notice, for conduct that violates these Terms, harms other users, or exposes us to legal risk. You may stop using the Service and delete your account at any time. Sections 7–9, 12–14, and 16 survive termination.

These Terms are governed by the laws of Romania. Disputes shall be resolved by the competent Romanian courts. For consumers, this does not affect the right to bring proceedings in the courts of their place of residence where mandatory consumer-protection law so provides, nor the right to resort to out-of-court dispute resolution, including through the National Authority for Consumer Protection (ANPC, anpc.ro).

We may modify these Terms. If a change is substantial, we will notify you by email or notice within the Service at least 14 days before it takes effect. If you do not agree to a change, you may stop using the Service before the effective date; continued use after that date constitutes acceptance.

If a provision is held unenforceable, it shall be modified to the minimum extent necessary and the remainder shall remain in force. These Terms and the Privacy Policy constitute the entire agreement between you and Daddy Freud regarding the Service. We may assign this agreement in connection with a merger or sale of assets. Failure to exercise a right does not constitute a waiver. These Terms are written in Romanian; an English version is made available for international users. In dealings with consumers in Romania, the Romanian version prevails.
