DaddyFreud is an AI-powered conversational companion developed and operated by Zahui Varga Erik ("Provider," "we," "us," or "our"), based in Bihor County, Romania. The Service is accessible via Telegram and related platforms.
DaddyFreud is built in collaboration with psychotherapists and is designed to simulate supportive, reflective conversation informed by therapeutic principles. It is a self-help and personal development tool — it is not a licensed mental health service, medical provider, or substitute for professional care.
These Terms govern your use of DaddyFreud and any associated features, services, and infrastructure ("Services"). By accessing or using the Services, you agree to be bound by this Unified Legal Policy.
2.1 Synthetic Interaction. You acknowledge that DaddyFreud is a synthetic AI entity. Under the EU AI Act, this is classified as a "Limited Risk AI system" designed for conversational simulation. DaddyFreud is designed to disclose its AI nature when sincerely asked.
2.2 Probabilistic Function. DaddyFreud operates via statistical language modelling and probability. It does not possess consciousness, feelings, understanding, a soul, or a moral compass. Responses that appear empathetic are the product of algorithmic design informed by psychotherapeutic expertise — not genuine emotion.
2.3 Accuracy & Reliability. AI-generated outputs may not always be accurate, even if they appear detailed or specific. You should not rely on any DaddyFreud output without independent verification, particularly for health, legal, or financial matters. The Service does not reflect guaranteed current, complete, or factually correct information.
2.4 No Professional Advice. The Service is strictly a self-help, personal development, and entertainment tool. It is not a substitute for clinical diagnosis, licensed psychotherapy, medical treatment, or legal advice. NEVER disregard or delay seeking professional medical or mental health advice because of something DaddyFreud said.
3.1 Minimum Age. You must be at least 18 years old, or the minimum age required to consent to data processing in your jurisdiction, whichever is higher, to use this Service.
3.2 Account Responsibility. You are responsible for all activity that occurs under your account. You may not share your account credentials with any other person. If you become aware of any unauthorized access to your account, you must notify us immediately at askdaddyfreud@gmail.com.
3.3 Accurate Information. You agree to provide accurate, current, and complete information when setting up your account or interacting with the Service.
3.4 Inactivity. We may suspend or delete accounts that have been inactive for over 12 months with no paid subscription. We will make reasonable efforts to notify you before doing so.
4.1 Permitted Use. You may access and use the Services for personal, non-commercial self-help and personal development purposes, in compliance with this Policy and all applicable laws.

5.2 Outputs. "Outputs" means the AI-generated responses you receive. Subject to your compliance with these Terms, you retain any rights you may have in Outputs generated specifically for you. However, similar or identical outputs may be generated for other users, and the Provider does not guarantee exclusivity.
5.3 Feedback. If you provide feedback, ratings, or suggestions regarding the Service, you grant us a perpetual, royalty-free, worldwide license to use such feedback without restriction or payment to you.
5.4 No Reliance. You agree not to make material decisions regarding your mental health, medical treatment, finances, legal matters, or personal safety based solely on DaddyFreud outputs without independent professional advice.
6.1 Legal Basis. Where required under the EU General Data Protection Regulation (GDPR) or applicable law, we process your data on the basis of your explicit, affirmative consent given by your use of this Service, the performance of our contract with you, and our legitimate interests in operating and improving the Service.
6.2 Special Category Data. By using DaddyFreud, you provide explicit, affirmative consent — pursuant to Art. 9(2)(a) GDPR — for the Provider to collect and process "Special Category Data" that you may voluntarily disclose, including but not limited to: your mental and emotional state, psychological history, sexual orientation, relationship status, political views, and health information as shared in your conversations.

7.1 Sub-Processors. DaddyFreud is powered by third-party large language model providers, which may include OpenAI (OpenAI OpCo, LLC), Anthropic (Anthropic PBC), Microsoft, and others (collectively, "AI Providers"). Your data may be transmitted to and processed by these AI Providers in order to generate responses.
7.2 International Transfers. By using the Service, you consent to your data being transferred to and stored in the United States and other jurisdictions outside the European Economic Area. Such transfers are governed by Standard Contractual Clauses (SCCs) or equivalent mechanisms as required by applicable law.
7.3 AI Provider Terms. Each AI Provider has its own terms and policies governing the processing of data submitted to their systems. The Provider is not responsible for the independent data practices of these AI Providers. You acknowledge that outputs are subject to the probabilistic nature of AI and the policies of the underlying providers.
7.4 No Endorsement. References to specific AI Providers do not imply endorsement by those providers of DaddyFreud.
8.1 Currency. All transactions are conducted via Telegram Stars, the internal currency of the Telegram platform. The Provider does not process fiat currency payments directly.
8.2 Immediate Digital Delivery. Upon the purchase and allocation of Stars credits or the activation of any premium feature, you acknowledge that the digital service is immediately and fully provided to you. The digital content is made available at the moment of purchase.
8.3 Waiver of Withdrawal Right. Pursuant to Article 16(m) of the EU Consumer Rights Directive (2011/83/EU), you explicitly and irrevocably waive your 14-day right of withdrawal because the performance of the digital service begins immediately upon your request and consent at the time of purchase.
8.4 No Refunds. Except where required by mandatory applicable law, all purchases are final. No refunds, chargebacks, or exchanges will be issued by the Provider for any reason, including dissatisfaction with AI outputs, accidental purchases, or account termination due to breach of these Terms.
8.5 Pricing Changes. We reserve the right to change the Star pricing for features at any time. Any price changes will be communicated in advance where reasonably possible.
8.6 Referral Program. If you participate in the referral programme, you earn Stars credits as described in the programme materials. The Provider reserves the right to modify or terminate the referral programme at any time. Credits earned are subject to the same no-refund policy.
9.1 Non-Clinical Tool. DaddyFreud is an off-therapy maintenance and personal development tool. It is not a crisis intervention service and not a substitute for emergency mental health support.
9.2 No Real-Time Monitoring. The Provider does not guarantee real-time monitoring of chat logs. If you communicate a crisis, plan to harm yourself, or express intent to harm others, automated systems may present crisis hotline information, but the Provider is under no legal obligation to alert local authorities or emergency services on your behalf.
9.3 Assumption of Risk. You assume all responsibility for your physical and mental well-being while using this Service. If you are experiencing a mental health emergency, please contact emergency services or a crisis line immediately:
The provision of these resources is a courtesy and does not imply a clinical duty of care on the part of the Provider.
10.1 No Adversarial Testing. You are prohibited from attempting "prompt injection," "jailbreaking," "social engineering," or any other method designed to bypass DaddyFreud's safety systems, reveal system prompts, or manipulate the AI into generating prohibited content.
10.2 No Reverse Engineering. You may not attempt to decompile, disassemble, or otherwise reverse-engineer the Service, including its models, algorithms, or system architecture.
10.3 No Competitive Use. You may not use DaddyFreud's outputs or architecture to develop, train, or inform a competing AI model or service.
10.4 Security Incidents. If you discover a security vulnerability in the Service, please disclose it responsibly by contacting us at askdaddyfreud@gmail.com before any public disclosure.
YOUR USE OF THE SERVICES IS SOLELY AT YOUR OWN RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, ACCURACY, OR NON-INFRINGEMENT.
11.1 No Liability for AI Errors. We are not responsible for any inaccuracies, omissions, or errors in AI-generated outputs, nor for any decisions made in reliance on such outputs.
11.2 Exclusion of Consequential Damages. To the maximum extent permitted by Romanian and applicable EU law, the Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, loss of data, emotional distress, or personal injury arising out of or related to your use of the Services.
11.3 Liability Cap. In no event shall the Provider's total aggregate liability to you for all claims arising out of or related to the Services exceed the equivalent value in Telegram Stars of your last 3 months of usage, or €50.00, whichever is lower.
Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for certain damages. In such jurisdictions, the above limitations apply to the fullest extent permitted by law.
You agree to defend, indemnify, and hold harmless Zahui Varga Erik and any affiliated persons from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
13.1 By You. You may stop using the Service at any time. Paid credits are non-refundable upon voluntary termination.
13.2 By Us. We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have breached these Terms, if required by law, or if your use poses risk to us, other users, or third parties.
13.3 Appeals. If you believe your account was suspended or terminated in error, you may contact us at askdaddyfreud@gmail.com to request a review.
13.4 Effect of Termination. Upon termination, your right to use the Service ceases. We may delete your data in accordance with our retention policy. Sections 5, 6, 11, 12, 15, and 16 survive termination.
14.1 Service Changes. We may add, remove, or modify features of the Service at any time. We will endeavour to provide advance notice of material changes where feasible, but reserve the right to make changes without notice when required for safety, legal, or operational reasons.
14.2 Policy Updates. We reserve the right to update this Unified Legal Policy at any time. When we do, we will revise the "Last Revised" date at the top of this document. If updates materially affect your rights, we will provide advance notice through the Service where reasonably possible. Your continued use of the Service after an update constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.
15.1 Governing Law. This Agreement is governed by the laws of Romania, without regard to conflict-of-law principles.
15.2 Informal Resolution. Before initiating formal proceedings, you agree to first contact us at askdaddyfreud@gmail.com and attempt to resolve any dispute informally for a period of at least 30 days.
15.3 Jurisdiction. If informal resolution fails, exclusive jurisdiction for any dispute lies with the Courts of Oradea, Bihor County, Romania.
15.4 Class Action Waiver. Any dispute or claim must be brought solely on an individual basis. You waive any right to participate in class action proceedings against the Provider.
15.5 Consumer Rights. Nothing in this section limits any mandatory consumer protection rights you may have under applicable EU or Romanian law.
16.1 Severability. If any provision of this Agreement is found to be unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remainder of this Agreement will remain in full force and effect.
16.2 No Waiver. Any failure by us to enforce a provision of these Terms does not constitute a waiver of our right to enforce it in the future.
16.3 No Assignment. You may not transfer or assign your rights or obligations under these Terms without our prior written consent. We may assign our rights without restriction.
16.4 Entire Agreement. This Unified Legal Policy constitutes the entire agreement between you and the Provider regarding the Services and supersedes all prior agreements, representations, or understandings.
16.5 Language. This Agreement is provided in English. In the event of any conflict between translated versions, the English version shall prevail.
16.6 Export Controls. You may not access or use the Services from jurisdictions subject to international sanctions or export control restrictions under applicable Romanian, EU, or US law.
